Terms & Conditions

The regulations specify the rules of providing sales services through the website of the online store operating under the domain: www.bardiel.eu.


It is a document required under Article 13 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827).

Before placing an order, the BUYER has the right to negotiate all provisions of the contract with the Seller, including those changing the provisions of the following regulations - within the limits allowed by the regulations. Negotiations, these shall require written form for their validity. In case the BUYER resigns from the possibility to conclude a contract by way of individual negotiations, the following regulations shall apply.


DEFINITIONS
1) INTERNET SHOP - means that the Agreement to sell or provide a service is concluded electronically and if the CONSUMER is a party to the agreement, it takes place under the conditions described in the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827).
2) SELLER and SERVICE COUNTER - BARDIEL, 2 Sulmińska Street, Niestępowo POLSKA NIP: 5842472156 - sales contract concluded through the website of the INTERNET SHOP www.bardiel.eu.
3) the CUSTOMER natural person, as well as a legal person and an organizational unit which is not a legal person, to which special regulations grant legal capacity, and which makes or intends to make an agreement or use other services offered through the website of the INTERNET SHOP.
4) CONSUMER - CUSTOMER, natural person performing with the SELLER a legal action not directly related to its business activity - precise definition - Civil Code Art.22.
5) PRODUCT - an item offered for sale or service offered in the INTERNET SHOP.
6) REGULATIONS - these Regulations of the INTERNET SHOP.
7) SALE CONTRACT - a contract of sale of the PRODUCT concluded at a distance through the INTERNET SHOP.
8) ORDER - a declaration made electronically about the desire to conclude a contract (order).


GENERAL PROVISIONS
Scope of activity - sale of BARDIEL handbags through an internet store.
Seller - in order to enable the conclusion of a contract, provides services through the website of the online store:
- creation and administration of a customer account in the online store
- processing of the order form for products in the Internet store.
Provision of electronic services in the above mentioned scope is free of charge.
The contract for the provision of electronic services consisting in maintaining and administering the Client's Account on the Site is concluded for an indefinite period of time. The moment of conclusion is considered to be the completion of the CLIENT's registration process on the WEBSITE.
The contract for the provision of electronic services consisting in enabling placing an Order in the Online Store by filling in the order form is concluded for a fixed period of time - for the period of filling in and processing the order - and is terminated upon placing and accepting the Order.
The CONSUMER may withdraw from the contract for the provision of services without giving reasons within 14 days from the conclusion of the contract - except for the provision of services - by submitting to BARDIEL a statement of withdrawal from the contract:
- by means of an electronic model withdrawal form
- by making a statement on the website,
- in the form of an e-mail to 

e-mail:bardiel.bags@gmail.com.


The SERVICE Provider may terminate the contract for the provision of services by electronic means if the CONSUMER objectively and illegally grossly violates the Regulations - with a 30-day notice period from the date of the notice. If both parties to the agreement are entrepreneurs, the LENDER may in such a situation terminate the agreement for provision of Electronic Service with immediate effect.
The SERVICE Provider and the CUSTOMER may terminate the agreement for the provision of electronic services at any time by agreement of the parties.
 Complaints shall be considered immediately not later than within 2 days after receiving the return of the bag. Information about acceptance or rejection of the complaint shall be sent to the buyer by e-mail. Failure to consider the complaint within this period means that the complaint is accepted.


 CUSTOMER - is obliged to enter data into the system in accordance with the actual state of affairs, in accordance with the law and good manners. The data provided shall not violate personal rights or property rights of third parties.
   
 An order may be placed only by e-mail or through the WEBSITE of the INTERNET SHOP.

The provisions of these Regulations are not intended to exclude or limit any rights of the CLIENT who is also a CONSUMER in the meaning of the Act of 23 April 1964 - Civil Code (Journal of Laws No. 16, item 93 as amended) - to which he is entitled by virtue of the binding legal regulations. In case of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail.

ORDERS
The SELLER complies with the Code of Good Practices within the meaning of the Act of 23.08.2007 on counteracting unfair market practices (content available at www.uokik.gov.pl/download.php?id=546).
   
You can place your order via e-mail 24 hours a day, 7 days a week.
   
Order processing - preparation and dispatch of BARDIEL takes place after receiving payment on account.
Deadline for order processing - no longer than 14 working days. Due to the fact that BARDIEL is manufactured by hand, in the case of a large number of orders, the deadline for processing may exceed 14 days from the date of receipt of funds on the account. The deadline will be specified when placing an order.
   

 PRICES
Product prices listed in the store's offer are prices in Euro and are gross prices (including legally required taxes, including VAT).
The prices are retail prices and do not include discounts and rebates. Discounts and rebates may be granted individually.

 

SHIPMENT OF GOODS, RETURNS, EXCHANGE
Prices of BARDIEL bags include delivery and return costs only if you wish to return the defective goods. Full value goods are returned at the expense of the buyer. If duty is due in each of these cases of both the purchase and return remains with the buyer.

Due to the fact that the bags are manufactured by hand and on individual order it is not possible to replace the bag (except for the defective product).

METHODS OF PAYMENT
We execute transactions using the following payment systems:
- PayPal
- Credit or debit cards

We send the purchased products by courier. We deliver the parcels:
- FedEx


COMPLAINTS AND RETURNS IN RELATIONS WITH CUSTOMERS
Complaints are realized only if the goods are defective. The complaint will be considered within 2 days from the receipt of the goods.The customer will receive an e-mail notification of its legitimacy.in the next stage after filling in the return form, the funds will be returned or the goods will be replaced anew (according to the customer's wish).


RETURN OF FUNDS
The refund will be made within 14 calendar days after the complaint is accepted and/or if you wish to return the bag using the payment used at the time of ordering.

 

Right to withdraw from the contract (RETURN OF GOODS) in case of distance selling involving the CONSUMER.
In accordance with Article 27 of the Act on Consumer Rights (Journal of Laws 2014, item 827), a CONSUMER concluding a "distance contract" has the right to withdraw from the contract without giving any reason - within 14 calendar days from the date of taking possession of the PRODUCT.


Withdrawal from the contract (return) as well as complaints must be submitted by e-mail using the return form in the shipping &returns tab.

The customer is asked to send back or hand over the goods to the courier, in an unchanged state from the moment of taking possession to the address of the Seller. The return shipment should be properly secured against damage during transport.


If an item sold has a defect, the buyer can demand that the item be replaced with a defect-free one or that the defect be removed. The SELLER is obliged to replace the defective item with a defect-free item or remove the defect within a reasonable time without undue inconvenience to the buyer.


PRIVACY & SAFETY
All personal data provided during the ordering process are used only to shape, conclude, change or terminate the Agreement between the LENDER and the CONSUMER and to execute the Sales Agreement or contract for the provision of electronic services or the execution of the order and are not made available to other institutions or third parties - with the exception of those described in point 2. Data acquisition and processing takes place in accordance with the Personal Data Protection Act of 29 August 1997 /Journal of Laws. No. 133, item 883 with later changes.
In case of selling products through the INTERNET SHOP in order to deliver the products to the CONSUMER, personal data necessary to address and deliver the parcel are transferred to courier companies, and in case of using the on-line direct payment system - to the payment system administrator.
The administrator of the CONSUMER's personal data collected through the INTERNET SHOP is the company:

The following CONSUMER'S data is required for the handling of the contract:
- surname and first name;
- address for shipping products;
- e-mail address;
- contact phone number.


FINAL PROVISIONS
The contract is concluded under the jurisdiction of Polish law.
The content of the Regulations is available all the time in the REGULATIONS tab on the Seller's website and can be copied and printed at any time by the Buyer.
   

In the event that the Regulations contain provisions contrary to the aforementioned or other regulations in force in the Republic of Poland - such regulations have priority over the wording of the Regulations.
If any of the provisions of these REGULATIONS are found to be illegal, invalid or otherwise unenforceable to the extent provided for by law, it shall be excluded in this respect. For the rest, the Regulations remain in force.
 All names of PRODUCTS offered for sale by the INTERNET SHOP are used for identification purposes and may be protected and reserved on the basis of the provisions of the Industrial Property Law Act (Journal of Laws 2001 No. 49 item 5081 as amended).
All photos placed on the WEBSITE are protected on the basis of the Act of 4 February 1994 on Copyright and Related Rights - (Journal of Laws 1994 No. 24 item 83 as amended) - have a creative and individual character. They cannot be copied without the consent of the Website Administrator.
In case of disputes related to the execution of the concluded agreement, the parties will strive to resolve the dispute by means of out-of-court amicable proceedings.
